Term of service

Welcome to use Neat photo album (hereinafter referred to as "this application"). These Terms of Service (hereinafter referred to as "these Terms") are jointly entered into by you (hereinafter referred to as "the User" or "you") and (hereinafter referred to as "us"), and are legally binding on both parties. Please carefully read and fully understand all the contents of these terms before registering, downloading, installing, or using this application, especially the disclaimer and liability limitation clauses highlighted in bold.

1、 Definition

Unless otherwise specified in this clause, the following terms have the following meanings:

·This application refers to the photo album management mobile application software called "Neat photo album" developed and operated by us, including its accompanying updates, upgrades, and derivative versions.

·User: Refers to natural persons, legal entities, or other organizations who download, install, register, or use this application.

·Content: Refers to the photos, images, videos, and other forms of digital content uploaded, stored, managed, and shared by users through this application.

·Service: refers to the general term for the album management, photo organization, image classification, storage, and other related functions that we provide to users through this application.

If you are a minor under the age of 14, you should read and agree to these terms with your guardian before using this application.

2、 Service Content

Neat photo album is a photo album management tool that mainly provides the following services for you:

·Local and cloud storage, classification, organization, and retrieval of photos and images;

·Auxiliary functions such as album creation, batch management, photo deduplication, and similar photo cleaning;

We have the right to add, change, suspend or terminate some or all of our services from time to time based on product planning, technological development or business needs, and notify you through in app notifications, announcements and other means.

3、 User behavior norms

When using this application, you are not allowed to engage in the following behaviors:

·Produce, upload, copy, publish, and disseminate content that violates laws, regulations, and public order and good customs, including but not limited to obscene, pornographic, violent, terrifying, gambling, fraud, and content that infringes on the legitimate rights and interests of others;

·Infringe upon the legitimate rights and interests of others, including intellectual property rights, trade secrets, portrait rights, privacy rights, reputation rights, etc;

·Engaging in behaviors that endanger network security and national security, or using this application to spread viruses, trojans, and other malicious programs;

·Unauthorized reverse engineering, decompilation, disassembly of applications, or attempting to obtain source code in any way;

·Disturb or disrupt the normal operation of this application and its related services, or maliciously attack this application using technical means;

·Engage in any form of commercial or for-profit activities unrelated to the functionality of this application;

·Other behaviors that violate laws, regulations, social ethics, or this clause.

If you violate the above regulations, we have the right to take measures such as warning, restricting functions, suspending or terminating services, banning accounts, etc. depending on the circumstances, and reserve the right to pursue legal responsibility.

4、 Intellectual Property

1. The copyright, trademark, and other intellectual property rights of this application and all its components (including but not limited to software, interface design, trademarks, logos, text, images, audio, video, code, etc.) belong to us or relevant rights holders and are protected by laws and regulations.

2. The intellectual property rights of the content uploaded or generated by you during the use of this application belong to you or the original rights holder. You grant us a non exclusive, free, worldwide, revocable license to provide you with this service (including storage, display, transmission, backup, and necessary technical processing).

3. Without our prior written consent, you may not copy, modify, disseminate, or sell any part of this application in any form.

5、 Privacy Protection

Protecting users' personal information is our important obligation. Our rules for collecting, using, storing, sharing, and protecting your personal information are detailed in the Neat photo album privacy policy. If this clause is inconsistent with the privacy policy, the provisions on personal information processing in the privacy policy shall prevail.

6、 Disclaimer

1. This application is provided "as is" and "as is", and we make no express or implied warranties, including but not limited to warranties of continuity, timeliness, security, accuracy, reliability, applicability, and defect free service.

2. If service interruption or data loss is caused by force majeure (including but not limited to natural disasters, government actions, network failures, power outages, computer viruses, hacker attacks, system maintenance, etc.), we will not be held responsible within the scope permitted by law, but will do our best to minimize the losses and impacts caused to you as a result.

3. You should backup the content stored through this application on your own. We are not responsible for data loss caused by equipment failure, network issues, misoperation, account abnormalities, or other non intentional or gross negligence on our part.

4. Any losses or third-party claims caused by your violation of these terms or laws and regulations shall be borne by you.

7、 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages (including but not limited to loss of profits, loss of data, loss of goodwill, business interruption, etc.), whether arising from the use or inability to use this application, or from other reasons under these terms, and whether or not we have been informed of the possibility of such damages. Our full responsibility to you shall not exceed the total amount of fees you have actually paid to us for using this application in the past twelve months under any circumstances.

8、 Service changes, interruptions, and terminations

We may make changes, upgrades, or suspend or terminate the provision of all or part of the services of this application based on business adjustments, technological upgrades, or legal and regulatory requirements. We will notify you in advance in a reasonable manner.

If you wish to stop using this application, you can uninstall it or cancel your account. After cancellation, we will delete or anonymize your relevant content and personal information in accordance with the law.

3. If you violate these terms, we have the right to suspend or terminate the provision of services to you at any time, and delete or remove relevant violations without any liability.

9、 Modification of terms

We may revise these terms in a timely manner. For major modifications, we will notify you through in app pop ups, push notifications, or announcements. The revised terms shall come into effect from the date of publication (if a different effective date is specified, it shall prevail). If you continue to use this application after the revised terms, it will be deemed that you have accepted the revised terms. If you do not agree with the revised content, you should stop using this application.
